If it's deliberate, sure.. If its a legitimate mistake then no.. Whiney little bitches who think they are entitled to anything because a mistake is made need a good slapping.
I disagree. It's not fair to advertise something at one price and then refuse to honour your advertising. It doesn't matter if they made a mistake - under basic contract law they offered and you accepted, and refusing to honour the deal is a breach of contract. Maybe next time they won't make a mistake. And this is coming from someone who works in retail and customer service. As bloody annoying as it is to deal with, I wouldn't dream of changing it because it offers me the protection when I'm in their circumstances. i agree with you, but unfortunately the law covers the retailer from making a mistake  some retailers honour those prices as a show of good faith, others do not.

That's incorrect. Mistake is not a defence under the Competition and Consumer Act to civil proceedings of misleading of deceptive conduct or misrepresentations about the price.

Come on, you've never made a mistake in your life? There should be some exclusions, as it could be enough to drive a company under, all because of a simple mistake.. often when an ad is checked by a junior person, or an external marketing company where it passes so through many hands mistakes can be made. It is simply unfair to expect no mistakes will ever be made, some of which for large companies can be very costly.
Usually the people complaining the most have never run a business in their life, or even come close to knowing the processes involved in these sort of things. Simply no idea.
Misrepresentation is not the same as a genuine mistake. I work for one of the major airlines, and if an incorrect fare is printed, it does *not* have to be honored.. the law is not on the side of the consumer for this one. This is why we are starting to have pages and pages of conditions for one simple offer or discount, and it's getting ridiculous... Because you have slime of society that go through and try and get things they are not entitled to because the terms & conditions simply leave out one small detail. All that it benefits is the already fat pockets of law firms, and the end result is higher costs of checking everything 50 times by more people, or getting it sent through legal (and the associated long delays).. end result: consumer suffers, and those costs get passed on.
I advertise something for $200, real price is $250. Sell 100 items, $5000 lost.. as a business owner, they just raise the price of everything to cover these eventualities? Maybe I just sack the person who made the mistake, and tell all my staff if they ever make a mistake they are out the door in an instant? Who wins here?

Of course everyone makes mistakes, but it's hyperbolic to claim that it would put a company under. If a business is making that many errors that it threatens their actual existence then they deserve to go under.
Misrepresentation can be a genuine mistake. It doesn't matter the reason why the prices were wrong - if they misrepresented the true price of something then you could sue. Obviously people don't, because it's typically a little thing. Being mistaken about some aspect of a contract doesn't provide a party with a right to rescind. If there's a unilateral mistake where one party is mistaken about an aspect of the contract (i.e. the price) but the other is not, the common law rarely provides a remedy. You can get rescission under equity but only where the person who was not mistaken (the buyer) acted improperly to hide the mistake from the other person.
When a company has made a genuine mistake in advertising it's considered proper to make it known by a newspaper ad and in-store corrections that there was a mistake. That stops future purchasers from claiming the deal. But those first few cabs off the ranks that complete a transaction at the listed price? You've got to honour it.

Got one. Paid $284 at the moment, going to get all those extra games for free, then when Smith has it for $199 I am going to refund and put it through again to get my $100 back.
All I have is Zelda for now =D I wanna check out the Ghost Recon game though, meant to be good.

Damn lad! Yeah, seeing all these deals, I wish I knew now that people are dropping the price early. Oh well. It was rad playing through Zelda, I finally finished it while I was away. Never finished OoT before that... my dirty secret.
Ghost Recon is pretty good. Not technically amazing but a fun game, and pretty challenging at times as well.

I haven't seen anyone dropping the price early. If they do, I'd like to hear about it. I want to sell off one of my U.S consoles and buy an Aussie one so that I can enjoy the best of both PAL and NTSC regions.

I asked at my local EB today and they said that they can price match for 7 days after the purchase. So, I decided to buy one, and then come back on Friday/whenever Smith lower the price to $200. Smith said they'd have their catalogue out on Wednesday, but I hope they put it out sooner. I hope this all works out. I guess the worst case scenario would be if I can't match Smith, then I'd just have to match EB's own price of $250.

D Smith will have it at $229 from the 12th to the 15th and then $199 from the 16th. Those dates won't be changing, but chances are another store such as JB or Big W will have it at $199 straight away.

Well you can still get the $248 deal at least.. just trade in super monkey ball towards a preorder, get an extra 50% credit.. surely they give at least $20 for it, so $30 back towards a preorder ain't bad.
I found out at work today that I'm pretty sure it will be $199 tomorrow at D Smith, they sent an email about it.

I like the aqua colour so much better than the black.  Anyway, I went back to EB today and they refunded the difference between what I paid on Wednesday and how much the console is going for now. I wasn't able to price match D Smith, unfortunately, since they had no stock left. Ah well, I'm not complaining!
